Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "the customer") and FreshWash ("we", "us", "our"). They apply every time you request, book, or receive a mobile car cleaning service from us, or use this website. By booking a service or submitting a request form, you confirm that you have read, understood, and agreed to these Terms.
1. What we provide
We provide mobile exterior and interior car cleaning at a location you choose. We are a cleaning service only. We are not a body shop, mechanic, paint correction specialist, detailer of record, restoration service, or insurer, and nothing we do should be understood as repair, refinishing, or mechanical work.
Cleaning is cosmetic and results vary with the age, condition, materials, prior damage, and prior treatments of your vehicle. We do not promise that any specific stain, odour, scratch, swirl, oxidation, water spot, mark, or blemish can be removed.
2. Booking, pricing, and payment
- Prices shown on this site are starting prices for standard vehicles in ordinary condition. Small vehicles are $25 for exterior or interior cleaning and $45 for both; large vehicles, SUVs, and trucks are $35 for exterior or interior cleaning and $65 for both.
- Excessive soiling, pet hair, biological waste, sand, mould, smoke residue, spills, construction dust, or oversized vehicles may require additional time and an additional charge. We will tell you the revised price before we begin, and you may decline.
- Submitting the booking form is a request, not a confirmed appointment. An appointment exists only once we confirm it by phone, text, or email.
- Payment is due on completion unless we agree otherwise in writing. Unpaid balances may be referred for collection, and you are responsible for reasonable collection and legal costs.
- Quoted times are estimates. Weather, traffic, water or power availability, and earlier appointments can shift arrival windows.
3. Your responsibilities before we arrive
You must do all of the following. If you do not, we may decline the job, stop work, or charge for the time reserved, and we are not responsible for any resulting loss or damage.
- Remove all personal property, valuables, cash, electronics, jewellery, documents, weapons, medication, keys, tools, child seats, and loose items from the vehicle before we start.
- Confirm that you are the owner of the vehicle or are authorised by the owner to have it cleaned, and that you have authority to accept these Terms on the owner's behalf.
- Disclose in advance any existing damage, aftermarket paint or wrap, repainted or touched-up panels, loose or damaged trim, cracked glass, faulty seals, non-working windows or locks, rust, prior water intrusion, electrical faults, modifications, or sensitive finishes.
- Provide safe, legal, and lawful access to the vehicle, and a location where we can work safely. This includes reasonable space, permission from the property owner or HOA, and compliance with local rules on water use and run-off.
- Secure pets and keep children away from the work area, equipment, hoses, and chemicals.
4. No responsibility for lost, stolen, or forgotten property
We do not accept custody, control, or safekeeping of any personal property. No bailment is created.
To the fullest extent permitted by law, we are not liable for any item that is lost, missing, stolen, damaged, discarded, or misplaced in, on, or around your vehicle before, during, or after a service — including cash, wallets, phones, chargers, laptops, tablets, headphones, cameras, keys, remotes, toll tags, garage openers, sunglasses, jewellery, watches, handbags, tools, sports equipment, luggage, paperwork, registration or insurance documents, medication, firearms, ammunition, alcohol, controlled substances, car seats, pet items, or anything else left in the vehicle.
Items left in the vehicle may be moved, vacuumed, or discarded as ordinary refuse in the course of cleaning. Loose paper, receipts, wrappers, cups, containers, and similar items will be treated as trash unless you tell us otherwise in writing beforehand. We are not responsible for anything discarded.
We do not search for, inventory, store, or return found property, and we are not responsible for property left with us or at the service location.
You are responsible for locking and securing your vehicle after we finish. We are not responsible for theft, vandalism, towing, parking citations, or damage occurring at the service location, whether before, during, or after our visit.
5. Pre-existing damage and condition
Cleaning removes dirt, and removing dirt reveals what was already underneath. We are not responsible for pre-existing or latent conditions that become visible, audible, or worse once the vehicle is clean or once water, air, or normal cleaning products contact it.
- Existing scratches, chips, swirls, dents, dings, rust, oxidation, clear-coat failure, fading, peeling paint, or previous poor-quality repairs.
- Failing or worn seals, gaskets, weather-stripping, window channels, sunroofs, convertible tops, and door or trunk seals, and any water intrusion through them.
- Loose, brittle, cracked, sun-damaged, or previously repaired trim, emblems, mouldings, mirrors, spoilers, antennas, wipers, hub caps, wheel covers, plastic, vinyl, wraps, decals, or tinting — including anything that detaches or lifts during normal washing or drying.
- Cracked, chipped, or stressed glass and light housings that spread or fail on contact with water, temperature change, or pressure.
- Worn, torn, stained, brittle, mould-affected, or already-damaged upholstery, leather, headliner, carpet, dashboard, or plastics, and any fault line that opens during vacuuming or wiping.
- Electrical faults, sensors, cameras, microphones, speakers, screens, wiring, or aftermarket installations affected by moisture, and any pre-existing mechanical or electrical condition.
- Odours, mould, mildew, or staining that cannot be fully removed by cleaning, and stains that reappear through wicking after drying.
- Damage caused by the products, waxes, coatings, dyes, sealants, or repairs previously applied by you or a third party.
6. Damage claims
If you believe we caused damage, you must notify us and let us inspect the vehicle before it is moved, washed again, repaired, or altered, and in any event within 24 hours of the service being completed. Claims reported after that window, or after the vehicle has been driven, cleaned, or worked on by someone else, cannot be verified and are waived to the fullest extent permitted by law.
You must give us a reasonable opportunity to inspect and, at our option, to re-clean or remedy the issue before you incur any third-party cost. We are not responsible for repair work, replacements, or costs you arrange without our prior written agreement.
Photographs taken at the time of service, if any, are evidence of condition. We may decline service, or note conditions in writing, at our discretion.
7. Cancellation, no-shows, and access
- Please give us at least 12 hours' notice to cancel or reschedule.
- If we arrive and the vehicle is unavailable, inaccessible, blocked, locked, moved, occupied, or unsafe to work on, or if no one is present to grant access, we may treat it as a no-show and charge a reasonable call-out fee for the reserved time.
- We may cancel, postpone, or shorten a service for weather, safety, illness, staffing, equipment failure, lack of water or power, or any condition we judge unsuitable. Our only obligation in that case is to reschedule or refund amounts you have paid for the cancelled service.
- We may refuse or stop any service at our discretion, including for unsafe conditions, biohazards, abusive behaviour, or suspected illegal activity.
8. Satisfaction, refunds, and no warranties
If you are not happy with the cleaning, tell us within 24 hours and we will make a reasonable effort to re-clean the affected area. Re-cleaning is our primary remedy. Any refund is at our discretion and is limited to the amount you paid for the service in question.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE PERFORMANCE, AND NON-INFRINGEMENT. NO EMPLOYEE, CONTRACTOR, OR AGENT MAY VARY THIS EXCEPT IN A SIGNED WRITING.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO A SERVICE, THESE TERMS, OR THIS WEBSITE — WHETHER IN CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY — IS LIMITED TO THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE IN QUESTION.
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF USE, LOSS OF VALUE, DIMINISHED VALUE, LOSS OF INCOME OR PROFIT, RENTAL OR SUBSTITUTE TRANSPORTATION COSTS, TOWING, STORAGE, DELAY, INCONVENIENCE, OR LOST DATA, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for gross negligence, wilful misconduct, or personal injury where the law does not permit exclusion. Where a limitation is unenforceable, it applies to the maximum extent the law allows and the rest of these Terms remain in force.
10. Assumption of risk and indemnity
You accept that mobile cleaning involves water, cleaning products, electrical equipment, and hoses at a location you selected, and you assume the ordinary risks of that activity, including wet or slippery surfaces.
You agree to indemnify, defend, and hold harmless FreshWash and its owners, employees, and contractors from any claim, loss, damage, fine, or cost (including reasonable legal fees) arising from your breach of these Terms, inaccurate information you gave us, property you left in the vehicle, your lack of authority over the vehicle, unsafe or unauthorised conditions at the service location, water use or run-off restrictions at that location, or injury to you, your household, guests, or pets.
11. Photos and reviews
We may photograph or video vehicles before and after a service for quality records, damage documentation, and marketing. We will not publish licence plates or identifying personal details. Tell us in writing if you do not want your vehicle used in marketing and we will honour that.
12. Website use
This website is provided for information and booking. We try to keep prices and details accurate but do not guarantee that the site is error-free, complete, current, or uninterrupted, and we may change prices, services, or content at any time. All text, images, and branding on this site belong to us and may not be copied or reused without permission.
13. Disputes and governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You and we agree that any dispute will be brought exclusively in the state or federal courts located in Dallas County, Texas, and each of us consents to that jurisdiction and venue.
You and we each agree to bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative action, to the fullest extent permitted by law.
Any claim must be brought within one year of the service it relates to, or it is permanently barred, to the fullest extent permitted by law.
14. Changes to these Terms
We may update these Terms at any time by posting a revised version on this page with a new effective date. The version posted at the time you book applies to that booking. Continuing to use our services after a change means you accept the updated Terms.
15. Entire agreement and contact
These Terms, together with any written confirmation of your appointment, are the entire agreement between us and replace any earlier discussions or understandings. If any provision is found unenforceable, the rest stays in effect.
